Toxic
Tort
What
is Toxic Tort Litigation? Toxic tort is
a personal injury alleged to be caused by exposure
to a particular substance. Some examples include
asbestos, silica, pharmaceuticals, lead-based paint,
pesticides, solvents, industrial chemicals, tobacco,
and hazardous waste. The years since the mid-1970’s
have seen huge increases in the number of lawsuits
filed against companies, and also in the types of
substances alleged to be toxic.
It is a difficult issue facing business owners as
they assess both their potential for liability,
and what exactly constitutes a toxic substance.
The Clary Firm, P.C. defends companies which have
been sued in connection with asbestos-related toxic
tort claims.
Product and Premises Defense -
The Clary Firm, P.C. represents both product and
premises defendants in toxic tort litigation. The
firm currently maintains an active statewide product
and premises docket and has successfully defended
major companies against a variety of toxic tort
related claims.
National Counsel - The firm also
serves as national counsel to companies involved
in litigation in multiple states. It is imperative
for a company involved in similar litigation in
multiple jurisdictions to have a consistent and
uniform approach to litigation strategy and discovery.
In its capacity as national counsel, the Clary Firm
is not only responsible for Texas litigation, but
also coordinates and leads defense counsel on a
nationwide basis. The firm attorneys work closely
with law firms in many other states to manage and
coordinate a consolidated national strategy, while
maintaining sensitivity to the nuances of litigation
techniques in each area of the country.
